What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant did not attend the hearing despite being properly served with notice. Tenant had been residing in the basement unit without paying rent since December 1, 2021, when the previous lease-holding tenant vacated.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying $29,086.00 by February 13, 2023. If not voided, the Tenant must vacate by February 13, 2023, and pay $27,386.00 plus $55.89 per day from February 1, 2023, until move-out. The Landlord may file for eviction enforcement starting February 14, 2023, if the unit is not vacated.
