What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit prior to the hearing date.
The ruling
The tenancy is terminated effective March 31, 2022. The Tenants must vacate the rental unit by this date. If the Tenants pay $1,663.96 to the Landlord or the Board by March 31, 2022, the eviction order will be void and the Tenants can remain in the unit. If the unit is not vacated by March 31, 2022, the Landlord can file the order with the Court Enforcement Office to enforce the eviction.
