What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and persistent late payment. The Tenant did not attend the hearing. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears. The Landlord withdrew the L2 application for persistent late payment during the hearing.

The ruling

The tenancy is terminated unless the Tenant voids the order by paying $27,350.00 by February 24, 2023. If the Tenant does not void the order, they must pay $23,236.63 to the Landlord and vacate the unit by February 24, 2023. The Tenant will owe $76.11 per day for use of the unit starting February 7, 2023, until they move out. The L2 application for persistent late payment was withdrawn.
