What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not paid the full rent from June 1, 2020 to November 30, 2020.

The ruling

The tenancy is terminated effective November 23, 2020 unless the tenant pays the arrears of $1,622.98 by that date. If the tenant fails to make this payment, the landlord may file the order with the Court Enforcement Office to enforce the eviction. The landlord owes the tenant $107.85 for the rent deposit and interest, but the landlord is authorized to offset this amount with compensation for the tenant's continued occupation and the application filing fee.
