What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Landlord served a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit prior to the hearing date.

The ruling

The tenancy was terminated effective February 20, 2022, the date the Tenant was ordered to vacate the rental unit. The Tenant is ordered to pay $10,188.53 to the Landlord, which includes rent arrears up to the move-out date and the cost of filing the application, less the rent deposit and interest on the deposit. The Tenant is also ordered to pay $50.40 per day for compensation for the use of the unit starting February 10, 2022 until the Tenant moves out.
