What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord also applied to terminate the tenancy because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser requires possession for residential occupation.
The ruling
The tenancy between the Landlord and the Tenant is terminated as of August 2, 2021, the date vacant possession was returned to the Landlord. The Tenant shall pay the Landlord $7,537.33, which represents the amount of rent owing and compensation up to July 31, 2021. The Tenant shall also pay the Landlord $201.00 for the cost of filing the application. If the Tenant does not pay the full amount owing by November 6, 2021, the Tenant will start to owe simple interest at 2.00% annually on the balance outstanding.
