What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The tenancy is terminated effective August 15, 2020. The Tenants must move out of the rental unit on or before August 15, 2020. The Tenants shall pay the Landlord $2,930.38 for arrears and costs owing to December 31, 2019, as well as $37.61 per day for compensation for the use of the unit starting January 1, 2020 to the date the Tenants move out, less any amount paid by the Tenants to the Landlord after the hearing date, less the rent deposit and interest. The Tenants shall also pay the Landlord $175.00 for the cost of filing the application.
