What happened

Landlords applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant had not paid the full rent owed from December 1, 2019 to November 30, 2020, leading the Landlords to serve a Notice of Termination effective January 31, 2020. The parties had entered into a repayment agreement under section 206 of the Residential Tenancies Act, 2006 two days before the hearing.

The ruling

The Tenant shall pay the Landlords $2,955.00 for the period ending November 30, 2020 in installments over the period of December 1, 2020 to October 1, 2025. The Tenant shall also pay the Landlords rent owing for the months of December 2020 to October 2025, no later than the first day of each month. If the Tenant fails to make any one of the payments, the outstanding balance shall become immediately due and owing, and the Landlords may apply to the Board for an order terminating the tenancy and evicting the Tenant.
