What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had resided in the rental unit for over eight years and relied on income from Ontario Works.
The ruling
The tenancy was terminated effective November 24, 2021. The Tenant was ordered to pay $2,232.40 to the Landlord, which includes rent arrears and compensation, less the rent deposit and interest owed on the deposit. The Tenant was also ordered to pay $14.79 per day in compensation starting November 3, 2021 until the Tenant vacates the unit. If the Tenant pays $3,336 by November 24, 2021, the eviction order will be void and the Tenant can remain in the unit.
