What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The parties agreed on the amount of arrears owing and the tenancy would terminate February 28, 2023.

The ruling

The tenancy will terminate on February 28, 2023 unless the Tenants pay $5,386.26 to void the order and continue the tenancy. If the Tenants do not pay the amount, the tenancy will be terminated, and the Tenants must move out by February 28, 2023. The Tenants will also owe the Landlord $1,171.94, which includes rent arrears, the application filing fee, and NSF charges, minus the rent deposit and interest.
