What happened
The Landlord applied for an order to determine whether the Residential Tenancies Act, 2006 applies. The Landlord argued that JB and his girlfriend are not tenants as defined in the Act, as they did not have a lease agreement with the Landlord and did not pay rent directly to the Landlord.
The ruling
The Residential Tenancies Act, 2006 does not apply to JB and his girlfriend, as they do not meet the definition of 'tenant' under the Act. The Landlord is not required to treat them as tenants.
