What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
The ruling
The tenancy is terminated unless the Tenants void the order by paying the outstanding amount of $7,301 by November 30, 2022, $9,601 by December 31, 2022, or $11,901 by January 31, 2023. If the Tenants do not void the order, they must move out by January 31, 2023 and pay the Landlords $2,291.50 plus daily compensation of $75.62 from October 26, 2022 until the move-out date.
