What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not vacated the rental unit by the hearing date.

The ruling

The tenancy is terminated effective July 15, 2021. The Tenants must move out of the rental unit on or before July 15, 2021. The Landlord is authorized to offset $48.11 per day for compensation for the use of the unit starting June 22, 2021 to the date the Tenants move out, and $186.00 for the cost of filing the application. If the Tenants wish to void the order and continue the tenancy, they must pay $1,557.79 on or before June 30, 2021, or $3,021.22 on or before July 15, 2021.
