What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to their failure to meet a condition specified in a previous order issued by the Board. The condition was that the Tenants refrain from yelling, swearing or causing any kind of disturbance in the residential unit or complex, and refrain from yelling or threatening the Landlord, staff or residents of the residential complex.
The ruling
The tenancy between the Landlord and the Tenants is terminated effective August 15, 2020. The Tenants owe no money to the Landlord as the amount of the rent deposit and interest the Landlord owes on the rent deposit exceeds the amount the Landlord is entitled to under this order by $677.80. The Landlord is authorized to offset $27.25 per day for compensation for the Tenants' continued occupation of the unit starting August 5, 2020 until the date the Tenants move out.
