What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation. The N12 notice served to the Tenant was found to be defective as the rental unit was not properly identified.

The ruling

The Landlord's application is dismissed without prejudice. The Tenant is ordered to return the $750 compensation paid to the Landlord by November 30, 2021. If the Tenant fails to comply, the Tenant will start to owe interest at 2% annually on the outstanding balance.
