What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice of Termination effective December 19, 2019, which the tenants did not void by paying the arrears. The tenants had not attended the hearing.
The ruling
The tenancy is terminated effective February 9, 2021. The Tenants are ordered to pay $18,694.66 to the Landlord, which includes rent arrears up to January 29, 2021 and the Landlord's filing fee, less the rent deposit and interest. The Tenants shall also pay $39.45 per day in compensation for the use of the unit from January 30, 2021 until they vacate. If the Tenants do not pay the full amount by February 9, 2021, they will owe simple interest at 2% annually on the outstanding balance.
