What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not paid the total rent owed from October 1, 2019 to November 30, 2020.

The ruling

The tenancy is terminated effective January 5, 2021. The tenant must pay the landlord $11,522.73 in rent arrears and application costs, plus $26.14 per day starting December 24, 2020 until the tenant vacates. If the tenant pays $11,895 by December 31, 2020 or $12,690 by January 5, 2021, the eviction order can be voided and the tenancy can continue.
