What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Cindy Wright had vacated the rental unit on September 1, 2020, prior to the hearing date.

The ruling

The tenancy was terminated effective January 3, 2021. The Tenants are ordered to pay $20,175 to the Landlord, which includes rent arrears up to November 30, 2020 and the cost of filing the application, minus the rent deposit and interest on the deposit. If the unit is not vacated by January 3, 2021, the Tenants shall pay the Landlord $36.16 per day for compensation for the use of the unit starting January 4, 2021 until the Tenants move out.
