What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date. On the hearing date, the Landlord's representative indicated that the Tenant had paid the arrears and requested consent to withdraw the L1 application. The Landlord is not seeking eviction and instead requests a pay on time order.

The ruling

The L1 application is withdrawn with the consent of the Board. The Tenant shall pay the Landlord $92.63, which represents the balance owing for the application filing fee, by January 30, 2022. If the Tenant fails to make this payment, the Tenant will start to owe interest at 2.00% annually on the outstanding balance. The Tenant shall pay the lawful monthly rent of $1,876.60 on or before the first business day of each month from January 2022 to December 2022. If the Tenant fails to make any of these rent payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant without further notice.
