What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective February 9, 2021. The Tenant must pay $5,094.73 to the Landlord, plus $60.82 per day from January 30, 2021 until the Tenant vacates the unit. The Tenant can void the order by paying $5,470.00 by January 31, 2021 or $7,360.00 by February 9, 2021. The eviction cannot be enforced by the Sheriff until the COVID-19 related regulation is removed.
