What happened
Landlord applied for an order to terminate the tenancy and evict Tenants for the purpose of residential occupation by the Landlord and a person who will provide care services to the Landlord. The application was dismissed due to a defective N12 notice that incorrectly identified the rental unit address.
The ruling
The Landlord's application for termination and eviction is dismissed without prejudice due to a defective N12 notice. The Tenants are ordered to return any rent compensation paid by the Landlord pursuant to section 48.1 of the Residential Tenancies Act.
