What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date and an amount for reasonable out-of-pocket expenses with regards to the Tenants not paying the utilities they were required to pay under the terms of the tenancy agreement.

The ruling

The tenancy is terminated effective May 31, 2022, the date the Tenants vacated the rental unit. The Tenants are ordered to pay the Landlord $2,311.49, which includes compensation for the use of the unit from October 16, 2021 to May 31, 2022, less the rent deposit and payments made by the Tenants, plus the cost of filing the application. If the Tenants do not pay the full amount by August 30, 2022, they will start owing interest at 3% annually on the outstanding balance.
