Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's failure to pay utility costs as required under the tenancy agreement, which substantially interfered with the Landlord's reasonable enjoyment or lawful rights, privileges or interests.
The ruling
The Landlord's application is granted. The tenancy will continue if the Tenant pays the Landlord $2,243.83 for unpaid utilities, $113 for the cancelled mould inspection, and $201 for the application filing costs by March 11, 2023. The Tenant must also pay the Landlord's full share of gas and water/sewer bills within 7 days of receiving the bills for the next year. If the Tenant fails to comply, the Landlord may apply to terminate the tenancy and evict the Tenant.
