What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant did not void the N4 Notice by paying the arrears. The Tenant cited issues with other tenants and maintenance problems affecting her ability to pay rent on time.
The ruling
The Landlord's application for eviction is denied on the condition that the Tenant follows a payment plan. The Tenant must pay $500 per month from November 1, 2022, to October 1, 2023, plus a final payment of $449 on November 1, 2023, to clear the arrears. The Tenant must also pay the monthly rent of $781 on time. If the Tenant fails to make payments as ordered, the Landlord may apply for eviction within 30 days of the breach.
