What happened

Landlord applied for an order to increase the rent above the guideline due to capital expenditures. The tenant, Christine Bell, filed a T1 application for rebate of money the landlord owes based on the rent increase charges between January 1, 2019 and November 1, 2020, asserting the landlord charged illegal rent during this period.

The ruling

The landlord may increase the rents charged by 5.20% for the units, with 3.00% increase from January 1, 2019 to December 31, 2019, and 2.20% increase from January 1, 2020 to December 31, 2020. The landlord or the tenants shall pay to the other any sum of money that is owed as a result of this order within 30 days.
