What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. This was the Landlord's third attempt to evict the Tenants using an N12 notice.

The ruling

The Landlord's application is dismissed as withdrawn. The Landlord is ordered to pay the Tenants costs in the amount of $450.00 by January 28, 2022. If the Landlord fails to pay the full amount by the due date, the Landlord will start to owe simple interest at 2.00% annually on the outstanding balance.
