What happened
Landlord applied for an order to terminate the tenancy of the Estate of James Quinn and remove any unauthorized occupants from the rental unit. James Quinn, the tenant, passed away on April 7, 2020 and his son Kenneth Quinn remained in the unit without a tenancy agreement.
The ruling
The tenancy between the Landlord and Tenant was terminated by operation of law 30 days after the Tenant's death. The Unauthorized Occupant must vacate the unit by May 15, 2021 and pay the Landlord $17,824.72 in compensation for use of the unit, plus $49.18 per day from May 5, 2021 until the date they vacate. If the Unauthorized Occupant does not pay the full amount by May 15, 2021, they will owe interest at 2% on the outstanding balance.
