What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The parties reached an agreement for the tenant to vacate the unit by March 31, 2021.

The ruling

The tenancy is terminated effective April 9, 2021. The Tenant must pay the Landlord $10,931.30, which includes rent arrears, compensation, and application filing fees, less the rent deposit and interest owed on the deposit. The Tenant can void the order by paying $12,981 by March 31, 2021 or $14,676 by April 9, 2021. If the Tenant does not pay the full amount by April 30, 2021, they will owe interest on the outstanding balance.
