What happened

Tenant applied for an order determining that Landlord failed to meet maintenance obligations under the Residential Tenancies Act, 2006. The main issue was the condition of the fridge, which was extremely rusty. Other issues included a leaking faucet, a kitchen window that would not close properly, and issues with the paint and condition of the walls.

The ruling

The Landlord was ordered to replace the fridge with a fridge in good working order and good state of repair by February 28, 2018. The Tenant was entitled to a $200 rent abatement for the fridge issue and a further $50 per month rent abatement if the fridge was not replaced or the walls were not repaired and repainted by the deadline.
