What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Tenant disputed the dates on the N8 notice, but the evidence showed he had been late paying rent 11 out of 11 months.

The ruling

The tenancy is terminated, and the Tenant must vacate the unit by September 30, 2019. The Landlord is authorized to offset the amounts owed from the rent deposit and interest. If the unit is not vacated by the deadline, the Landlord may file the order with the Sheriff for enforcement.
