What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant admitted owing $2,188 in rent arrears up to August 31, 2017, and agreed the Landlord was entitled to the $190 application fee. The key issue was whether the Board should refuse or delay the Tenant's eviction despite the rent owing.

The ruling

The Board denied the Landlord's request to evict the Tenant and instead imposed a conditional order. The Tenant was ordered to pay the $2,378 in rent arrears and costs in installments by April 1, 2018, and to pay new rent on time and in full. If the Tenant fails to make any of the payments, the Landlord may apply to the Board for an order terminating the tenancy and evicting the Tenant.
