What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's failure to meet the conditions specified in a previous order issued by the Board on August 4, 2021 with respect to application SWL-52160-21. The Tenant had made limited payments that were inconsistent with the conditions set out in the previous order, resulting in accumulated unpaid rental payments.

The ruling

The Landlord's application under section 78 of the Act is dismissed as the Board does not have jurisdiction to consider this application as it was filed beyond the statutory 30-day period after the alleged breaches had taken place.
