What happened

Tenants applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The Tenants claimed a rent abatement of $154.95 and out-of-pocket expenses of $440.00 due to a major water leak from the unit above them.

The ruling

The Tenants' application is dismissed. The Landlord took immediate action to correct the bathtub overflow problem, install drying fans to remove all dampness, and promptly bring the rental unit back to a dry, good state of repair and fitness. The dried brown water stains reported afterwards were not an emergency issue.
