What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to wilful or negligent damage to the rental unit. The Landlord served an N5 notice on the Tenant, giving the Tenant the option to either repair the damage or pay the cost of repair. The Tenant did not take either of these actions.
The ruling
The tenancy between the Landlord and Tenant is terminated as of August 31, 2021. The Tenant must move out of the rental unit on or before August 31, 2021. If the Tenant does not vacate by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction.
