What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation by the Landlord's son. The Landlord also applied for an order requiring the Tenant to compensate the Landlord for wilfully or negligently caused undue damage to the premises.

The ruling

The tenancy is terminated effective September 30, 2021. The Tenant must vacate the rental unit by that date. The Tenant is ordered to pay the Landlord $1,278.42 for the cost of repairing the damage to the rental unit, less the rent deposit and interest. The Tenant must also pay the Landlord $43.59 per day for compensation for the use of the unit from October 1, 2021 until the Tenant moves out.
