What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to allegations that the Tenant or someone he permitted caused undue damage to the premises by drilling a hole in the basement wall, and that the Tenant or someone he permitted committed an illegal act by using water from the neighboring unit without consent.
The ruling
The Landlord's application for eviction is denied on the condition that the Tenant or any occupant of the rental unit shall not create any hole on any wall of the rental unit without the Landlord's consent for one year from the date of the order. The Tenant is ordered to pay the Landlord $175 for the cost of filing the application.
