What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Landlord also claimed NSF cheque charges and related administration charges.
The ruling
The tenancy is terminated effective September 5, 2021, unless the Tenant pays the outstanding amount of $4,132.00 on or before August 31, 2021, or $5,401.00 on or before September 5, 2021 to void the eviction order and continue the tenancy. The Tenant must also pay the Landlord $1,893.38, which represents the amount of rent owing and compensation up to August 11, 2021 and the total charges related to an NSF cheque, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant shall also pay the Landlord $41.72 per day for compensation for the use of the unit starting August 12, 2021 to the date the Tenant moves out of the unit, and $186.00 for the cost of filing the application.
