What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to meet conditions specified in a previous LTB order. The Tenant failed to pay the full amount of $1,978.36 towards arrears by September 30, 2022, as required by the previous order.

The ruling

The tenancy is terminated effective January 24, 2023. The Tenant must pay $4,695.09 to the Landlord, representing rent arrears, NSF charges, and application fees, less the rent deposit and interest. The Tenant must also pay $42.29 per day from January 14, 2023, until they vacate the unit. If the Tenant does not vacate by January 24, 2023, the Landlord may file for eviction enforcement starting January 25, 2023.
