What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant had already vacated the rental unit on July 31, 2022, prior to the hearing date. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears.

The ruling

The tenancy was terminated effective July 31, 2022, the date the Tenant vacated the rental unit. The Tenant is ordered to pay $1,935.14 to the Landlord, which includes rent arrears up to the move-out date and the cost of filing the application, minus the rent deposit and interest on the deposit. If not paid by January 29, 2023, interest will start accruing at 5% annually.
