What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The landlord was unable to reach the tenants after the application was filed and believed one tenant may be deceased.

The ruling

The tenancy is terminated effective October 12, 2021. The tenants are ordered to pay $2,556.95 in rent arrears and application costs, plus $9.27 per day in compensation starting October 2, 2021 until they vacate the unit. If the full amount is paid by October 12, 2021, the eviction order will be void and the tenancy can continue.
