What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit on October 31, 2022, prior to the hearing date.
The ruling
The Tenants shall pay to the Landlord $15,146.52, which includes rent arrears owing up to the date the Tenants moved out of the rental unit and the cost of filing the application. The rent deposit and interest the Landlord owes on the rent deposit is deducted from the amount owing by the Tenants. If the Tenants do not pay the full amount owing by December 20, 2022, they will start to owe simple interest calculated at 4.00% annually on the balance outstanding.
