What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid the full rent from October 1, 2020 to July 31, 2021.

The ruling

The tenancy is terminated effective September 27, 2021. The Tenants must pay $6,415.20 to the Landlord, which includes rent arrears up to the termination date, compensation for use of the unit, and the application filing fee, less the rent deposit. If the Tenants pay $7,796.09 on or before September 27, 2021, the eviction order will be void and the tenancy will continue.
