What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to substantial interference with the Landlord's legal right to enter the property. The Tenants had added an additional locking device which effectively locked the Landlord out when she tried to enter the property to take pictures for listing it for sale.

The ruling

The Landlord's application for eviction of the Tenants is denied on the condition that Tenants will allow the Landlord lawful entry when provided with proper 24 hour written notice. If the Tenants refuse to allow the Landlord lawful entry, the Landlord can apply to the Board for an order terminating the tenancy and evicting the Tenants. The Tenants are ordered to pay the Landlord $186.00 for the cost of filing the application.
