What happened

Landlord filed an L2 application to terminate the tenancy and evict the Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Landlord also filed an L1 application for an order to terminate the tenancy because the Tenant did not pay the rent that the Tenant owes. The parties reached an agreement at the hearing.

The ruling

The tenancy shall terminate on November 30, 2020. If the Tenants fail to vacate the rental unit on or before the termination date, the Landlords may file the Order with the Court Enforcement Office (Sheriff) on or after December 1, 2020 for vacant possession of the rental unit. The Tenants will owe the Landlords $55.23 for each day the Tenants occupy the rental unit after the termination date. The last month rent on deposit shall be applied to the month of November 2020. The Landlord shall waive all rent arrears from April 2020 up to and including August 2020. The Tenant shall pay $3,360.00 rent arrears for September and October on or before October 31, 2020. The Landlord shall provide the Tenant with rent receipts spanning the period of December 1, 2017 to November 30, 2020. The Tenant shall leave the Rental Unit in broom swept condition and free of damages upon vacant possession. If the Tenant fails to make the payments as per paragraph 6, the Tenant will start to owe interest as of November 1, 2020.
