What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. During the hearing, the application was converted to an L9 application for arrears only. The Tenants failed to provide advance notice for raising issues under section 82 of the RTA.

The ruling

The Tenants are ordered to pay the Landlord $18,275.00 for rent arrears up to December 31, 2020, plus $186.00 for the cost of filing the application. If payment is not made by February 15, 2022, interest will start accruing at 2.00% annually on the outstanding balance from February 16, 2022.
