What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlords also claimed compensation for each day the Tenants remained in the unit after the termination date as well as NSF cheque charges and related administration charges.

The ruling

The tenancy between the Landlords and the Tenants shall continue but subject to the following order: The Tenants shall pay the lawful monthly rent for the 12-month period of March 1, 2021 to February 1, 2022 on or before the first day of each month. If the Tenants fail to make any payment in compliance with the order, the Landlords may apply for an order terminating the tenancy and evicting the Tenants. The Tenants shall also pay the Landlords $135.00 for NSF cheque charges and $175.00 for the cost of filing the application.
