What happened
The Landlord applied for an order requiring the Tenant to pay compensation for misrepresenting their income. The Tenant was the superintendent for the property and advised the Landlord they were quitting as of June 17, 2020. The Landlord terminated the tenancy and gave the Tenant until the end of June 2020 to vacate, but the Tenant refused to vacate or pay rent, claiming they could stay due to COVID-19. The Landlord had no place to house the new site manager and had to put them in a temporary suite.
The ruling
The tenancy between the Landlord and Tenant is terminated as of November 9, 2020. The Tenant must move out by that date and owes the Landlord $3,600 in rent up to October 31, 2020, plus $201 in application fees, and per diem rent of $29.59 from November 1, 2020 until the unit is vacated. If the Tenant does not pay the full amount by November 9, 2020, they will owe interest at 2% annually on the outstanding balance. If the unit is not vacated by November 9, 2020, the Landlord can file the order with the Sheriff to enforce the eviction.
