What happened

Landlord applied to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after the Landlord served a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The parties had previously reached a mediated agreement, but the Tenant failed to comply with the terms.

The ruling

The tenancy is terminated effective March 15, 2021. The Tenant must pay the Landlord $2,135.55 in rent arrears and application costs, plus $32.05 per day in compensation starting February 10, 2021 until the Tenant vacates. The Tenant can void the eviction order by paying $2,933 by February 28, 2021 or $3,908 by March 15, 2021.
