What happened

The Co-op applied to the Landlord and Tenant Board to end the occupancy of the member unit and evict the Co-op Member, who had passed away. The Co-op discovered that the unit was occupied by a female person who was not a member of the Co-op.

The ruling

The Co-op's application is dismissed. The LTB has no jurisdiction to evict an unauthorized occupant from a Co-op. The Co-op must seek a remedy from the appropriate court with jurisdiction over this issue.
