What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.

The ruling

The tenancy is terminated unless the Tenant pays $16,426.56 by 2023-01-31 or $18,346.32 by 2023-02-03 to void the order. If the Tenant does not void the order, they must pay $13,737.33 to the Landlord and vacate the unit by 2023-02-03. The Landlord is entitled to daily compensation of $63.12 for the Tenant's continued occupation after 2023-01-19.
